PUBLIC NOTICE

MORTGAGE FORECLOSURE SALE

Default having been made in the payment of the indebtedness secured by that certain mortgage executed by Bryant O’Neal Ross to Farmers and Merchants Bank dated April 13, 2018, said mortgage being recorded in the office of Judge of Probate of Chambers County, Alabama, at Document Number 2018, Page 1481, the undersigned Farmers and Merchants Bank, as mortgagee, under and by virtue of the power of sale contained in said mortgage, will sell at a public outcry to the highest bidder for cash, in front of the Chambers County Courthouse at LaFayette, Alabama, on the 11th day of April, 2023, during the legal hours of sale, the following described real estate, situated in Chambers County, Alabama to-wit: Lot Number (3) of Pine Hills Subdivision according to a Map or Plat thereof, dated September 6, 1968, prepared by J. D. McGill, L.S. 6731, and recorded in Map Book 4 at Page 128, records of Chambers County, Alabama. Said property is conveyed subject to the restrictions, covenants and conditions, which shall be construed as covenants running with the land, which may be enforced by any purchaser of any lot shown on plat, sold, subsequent to January 21, 1970, the same being more particularly set out and
described in that certain deed dated March 18, 1970, from J. S. White, Jr., and Allen T. White to Willie Ruth Smith, and being recorded in Deed Volume 184, Page 254, records of Chambers
County, Alabama. This being the same property more particularly described in that deed from
James Edward Wright to Willie Ella Whitlow dated January 26, 1971 and recorded in Deed Volume 187, Page 322, records of Chambers County, Alabama. This being the same property as conveyed by deed recorded in Deed Book 208 at Page 614 in the Office of the Judge of Probate of Chambers County, Alabama. Also including a 2015 Fleetwood Manufactured Home Serial Numbers FLE260GA14-60328A and FLE260GA14-60328B. The following notice is required because this property was elected as homestead with the Revenue Commissioner of Chambers County: “Alabama law gives some persons who have an interest in property the right to redeem the property under certain
circumstances. Programs may also exist that help persons avoid or delay the foreclosure process. An attorney should be consulted to help you understand these rights and programs as a part of the foreclosure process”. This sale is made for the purpose of paying the indebtedness secured by said mortgage, as well as the expenses of foreclosure.
