NOTICE OF MORTGAGE FORECLOSURE SALE
Default having been made in the payment of that certain promissory note and the terms of that certain mortgage executed by SUE’S CHIC, LLC, to MALINDA STRIBLIN, dated the 1st day of May, 2016, which mortgage was recorded in Document No. 2016-1579, in the Office of the Judge of Probate of Chambers County, Alabama, the undersigned MALINDA STRIBLIN, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash before the Courthouse door of the Chambers County Courthouse in LaFayette, Alabama, on April 12, 2023, or on such later date as circumstances may require, during the legal hours of sale, the following real estate, situated in Chambers County, Alabama, to wit:
What is known as Combs Business Block located on the East side of Fairfax, Alabama, more fully described as follows, to-wit; Begin at a point where the North and South section line between Sections 24, Range 28, and 19, in Range 29, Township 21, Chambers County, Alabama, intersects the South edge of a concrete sidewalk on the South margin of Fairfax and Riverview Highway. Thence measure in a Southeasterly direction along the South margin of said Highway for a distance of 379 feet to a point for a corner and starting point of the property to be described, said point being located on the East margin of Fairfax Boulevard; FROM THIS STARTING POINT, thence continue along the South margin of the above mentioned Highway for a distance of
224.5 feet to an iron pin for a corner; thence with a M.B. of South 87° 50’ West for a distance of 73 feet to an iron pin for a corner located on the East margin of an alley; thence with a M.B. of North 0° 30’ West along the East margin of said alley for a distance of
151.5 feet to a concrete monument for a corner, said monument also being the corner of the Fairfax Mill property; thence with a M.B. of 58º 50’ W along the Fairfax Mill property line for a distance of
143.5 feet to a concrete monument for a corner located on the East margin of Fairfax Boulevard; thence in a Northeasterly direction along the East margin of Fairfax Boulevard for a distance of 89 feet for a corner and starting point.
The above described property together with all improvements thereon is located in the Southwest ¼ of Section 19, Township 21, Range 29, Fairfax, Chambers County, Alabama, and is the same property which is described in deeds which are recorded in Deed Book 357, Page 127, and Document No. 1998-745 in the Office of the Judge of Probate of Chambers County, Alabama.
The indebtedness secured by said mortgage has been and is hereby declared due because of default under the terms of said promissory note, and any renewal or extension thereof, and mortgage, including but not limited to the nonpayment of the indebtedness as and when due. The indebtedness remaining in default, this sale will be made for the purpose of paying the same, all expenses of the sale, including a reasonable attorney’s fee, and all other payments provided for under the terms of the promissory note and mortgage.
The mortgagor has been furnished with written notice, mailed by certified mail to the property address at least thirty (30) days prior to the sale date, which notice provides as follows: “Alabama law gives some persons who have an interest in property the right to redeem the property under certain circumstances. Programs may also exist that help persons avoid or delay the foreclosure process. An attorney should be consulted to help you understand these rights and programs as a part of the foreclosure process.”
