FORECLOSURE NOTICE
Default having been made in the terms of a Note and Mortgage executed to the undersigned, Roger Parker and wife, Marion Parker, (Lenders), by Yerania del Carmen Zacarais Perez and Eduardo Gaspar Lux Sarat (Borrowers) on April 29, 2025, which said Mortgage is recorded in the Office of the Judge of Probate of Chambers County, Alabama, at Mortgage Document #2025-2189, and said default continuing, the undersigned, Roger Parker and wife, Marion Parker, will sell at public outcry, for cash, to the highest bidder, in front of the courthouse door of said County between the legal hours of sale, on the 15th day of May, 2026, the following described property, to-wit:
Commencing at the Northeast Corner of Section 12, Township 23 North, Range 27 East, Chambers County, Alabama; thence South 13 degrees 45 minutes 12 seconds West a distance of
3195.45 feet to an iron pin found (capped “Morkes”) and the POINT OF BEGINNING of the hereafter described property; thence South 15 degrees 13 minutes 56 seconds West a distance of
438.53 feet to an iron pin found (capped “Morkes”); thence South 15 degrees 19 minutes 40 seconds West a distance of
609.42 feet to an iron pin found (capped “Morkes”); thence South 88 degrees 14 minutes 42 seconds West a distance of
108.99 feet to an iron pin found (capped rebar); thence South 88 degrees 50 minutes 40 seconds West a distance of
239.77 feet to an iron pin found (axle); thence South 80 degrees 00 minutes 47 seconds West a distance of
13.20 feet to an iron pin found (capped rebar) on the Northeasterly Right-of-Way of Chambers County Road No. 263 (80’ Right-of-Way); thence along said Right-of-Way North 17 degrees 32 minutes 45 seconds West a distance of
538.79 feet to a point; thence North 17 degrees36 minutes 25 seconds West a distance of
261.61 feet to a point; thence North 17 degrees 35 minutes 44 seconds West a distance of
135.31 feet to a point; thence North 18 degrees 22 minutes 32 seconds West a distance of
176.67 feet to an iron pin found (½” rebar); thence leaving said Right-of-Way North 88 degrees 01 minutes 07 seconds East a distance of
712.90 feet to an iron pin found (capped “Morkes”); thence South 76 degrees 33 minutes 12 seconds East a distance of
271.08 feet to the POINT OF BEGINNING, containing
16.45 acres, more or less.
The above described parcel is more particularly shown on that certain plat of survey prepared by Blake Newell Turner, ARLS No. 50377, dated April 23, 2025.
This being a portion of the same property conveyed to Roger Parker and Marion Parker by that certain deed recorded in Document Number 2021-5092, in the Office of the Judge of Probate of Chambers County, Alabama.
Said sale is for the purpose of paying the unpaid principal on said Note and Mortgage, interest and attorney’s fees as provided in said Note and Mortgage, expenses of advertising, selling, conveying, and all other costs that may have accrued.
Furthermore, the property to be offered pursuant to this notice of sale is being offered for sale, transfer and conveyance AS IS, WHERE IS. Neither the Lenders, nor the attorneys or authorized representative of the Lenders make any representation or warranty relating to the title or any physical, environmental, health or safety conditions existing in, on, at or relating to the property offered for sale. Any and all responsibilities or liabilities arising out of or in any way relating to any such condition, including those suggested by Section 35-4-271, Code of Alabama, 1975, expressly are disclaimed. This sale is subject to all prior liens and encumbrances and unpaid taxes and assessments including any transfer tax associated with the foreclosure.
Alabama law gives some persons who have an interest in property the right to redeem the property under certain circumstances. Programs may also exist that help persons avoid or delay the foreclosure process. An attorney should be consulted to help you understand these rights and programs as part of the foreclosure process. This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances, and exceptions reflected in the Note and Mortgage and those contained in the records of the Office of the Judge of Probate in the county where the above-described property is situated. This property will be sold subject to any right of redemption of all parties entitled thereto and subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable). This sale is made for the purpose of paying the indebtedness secured by said Note and Mortgage, as well as the expenses of foreclosure. The Lenders reserve the right to bid for and purchase the real estate and to credit its purchase price against the expenses of sale and the indebtedness secured by the real estate. This sale is subject to postponement or cancellation.
