FORECLOSURE NOTICE
Default having been made in the terms of an Installment Sales Contract executed to the undersigned, Cody Development, LLC and JL Investments of Bay County, LLC (Contract Seller), by Amanda Nichole Spraggins and Joshua Coty Ray (Contract Purchaser) on April 26, 2019, which said contract is recorded in the Office of the Judge of Probate of Chambers County, Alabama, at Document #2019-1901, and said default continuing, the undersigned, Cody Development, LLC and JL Investments of Bay County, LLC, will sell at public outcry, for cash, to the highest bidder, in front of the courthouse door of said County between the legal hours of sale, on the 19th day of June, 2026, the following described property, to-wit:
PARCEL I:
Lots Number 25 and 26, of Block D, of the G. W. Crowder Addition to Langdale, Chambers County, Alabama. A plat of said subdivision is recorded in Map Book 1, Page 39, in the Office of the Judge of Probate of Chambers County, Alabama and said plat is included herein by reference. All of the above-described property being located in the Southwest Quarter of the Southeast Quarter of Fractional Section 7, Township 21, Range 29, of Chambers County, Alabama.
PARCEL II:
Begin at the intersection of the West margin of 18th Avenue, formerly McLaughlin Street, and the North margin of 53rd Street, formerly Lester Street; thence South 76 degrees 20 minutes West along the North margin of said 53rd Street for a distance of
120.0 feet to an iron pin for a corner and STARTING POINT of the parcel to be described. FROM THIS POINT OF BEGINNING, thence continue along the existing North margin of said street with a bearing of South 76 degrees 20 minutes West for a distance of
120.0 feet to an iron pin for a comer; said pin being located at the intersection of the North margin of said Street and the East margin of 19th Avenue, formerly Crowder Street; thence North 15 degrees 40 minutes West along the East margin of said 19th Avenue for
11.55 feet to a stake for a comer; thence North 81 degrees 50 minutes East for
120.6 feet to an iron pin for a corner and STARTING POINT. All of the bearings are magnetic.
The above-described property is a triangular piece of property and is in Section 7, Township 21 North, Range 29 East, of Chambers County, Alabama. A plat was prepared by Grady A. Fuller, L. S., dated February 6, 1961, and a copy of the same is attached to a certain deed recorded in Deed Book 154, Page 397, in the Office of the Judge of Probate of Chambers County, Alabama.
This being the same property conveyed to Cody Development, LLC and J.L. Investments of Bay County, LLC, by that certain deed dated January 28, 2016, being recorded in Document Number 2016-289, in the Office of the Judge of Probate of Chambers County, Alabama.
Said sale is for the purpose of paying the unpaid principal on said contract, interest and attorney’s fees as provided in said contract, expenses of advertising, selling, conveying, and all other costs that may have accrued.
Furthermore, the property to be offered pursuant to this notice of sale is being offered for sale, transfer and conveyance AS IS, WHERE IS. Neither the Contract Seller, nor the attorneys or authorized representative of the Contract Seller make any representation or warranty relating to the title or any physical, environmental, health or safety conditions existing in, on, at or relating to the property offered for sale. Any and all responsibilities or liabilities arising out of or in any way relating to any such condition, including those suggested by Section 35-4-271, Code of Alabama, 1975, expressly are disclaimed. This sale is subject to all prior liens and encumbrances and unpaid taxes and assessments including any transfer tax associated with the foreclosure.
Alabama law gives some persons who have an interest in property the right to redeem the property under certain circumstances. Programs may also exist that help persons avoid or delay the foreclosure process. An attorney should be consulted to help you understand these rights and programs as part of the foreclosure process. This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances, and exceptions reflected in the Installment Sales Contract and those contained in the records of the Office of the Judge of Probate in the county where the above-described property is situated. This property will be sold subject to any right of redemption of all parties entitled thereto and subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable). This sale is made for the purpose of paying the indebtedness secured by said Installment Sales Contract, as well as the expenses of foreclosure. The Contract Seller reserves the right to bid for and purchase the real estate and to credit its purchase price against the expenses of sale and the indebtedness secured by the real estate. This sale is subject to postponement or cancellation.
